1. Acceptance of Terms
By installing or using the Checker for Gmail™ browser extension, or by using this website (gmail.safex.cloud) (together, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.
2. Description of the Services
Checker for Gmail™ uses Gmail Atom for basic unread information and, after Google OAuth authorization, Gmail API for full messages, search, changes, and sending. Gmail mail data is processed only on your device and inside the extension. If you enable optional KeyLockr mode, only the encrypted portable IMAP/SMTP account bundle is synchronized to your KeyLockr AppData; templates, signatures, scheduled messages, and bodies are excluded. Google Chrome uses Chrome Identity; supported non-Chrome Chromium browsers store a separate web OAuth grant for each authorized account in extension-local storage. During exchange and refresh, authorization codes and tokens are encrypted with a SafeX public key pinned in the extension and a fresh per-request key before transiting this site's stateless proxy; they are decrypted only in proxy process memory and forwarded to Google, and are never stored or logged by SafeX. This website also provides informational pages and local-component distribution.
3. Google Trademarks; No Affiliation
Gmail™ and Google™ are trademarks of Google LLC. Checker for Gmail™ is an independent product of SafeX Inc. and is not affiliated with, associated with, sponsored by, or endorsed by Google LLC.
4. License and Acceptable Use
We grant you a personal, non-transferable, non-exclusive license to use the Services. You may not: reverse engineer the extension (except where such restriction is prohibited by law); use the Services for any unlawful purpose; or use the Services in a way that disrupts or abuses Gmail or Google services.
5. Privacy
How we handle data is described in our Privacy Policy.
6. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. Google may change the Gmail API, OAuth review requirements, or Chrome extension platform policies at any time, which may degrade or disable certain features; we do not guarantee the continued availability of any feature.
7. Limitation of Liability
To the fullest extent permitted by law, SafeX Inc. shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of data, loss of profits or business interruption, even if advised of the possibility of such damages. Our total aggregate liability for the Services shall not exceed the amount you paid for the Services in the twelve months preceding the event giving rise to the claim (or zero, if you use the Services free of charge).
8. Dispute Resolution
Governing Law.
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles.
Informal Resolution.
Before bringing any formal claim, you agree to first contact us at info@safex.cloud and attempt in good faith to resolve the dispute informally. Most concerns can be resolved this way.
Binding Arbitration.
Any dispute, claim, or controversy arising out of or relating to these Terms, our website, or our Services that is not resolved informally shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in a court of law. The arbitration shall be seated in Orange County, New York, and judgment on the arbitrator's award may be entered in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act.
Class Action Waiver.
You and SafeX Inc. agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any class or representative proceeding.
Jury Trial Waiver.
To the fullest extent permitted by applicable law, you and SafeX Inc. waive any constitutional or statutory right to sue in court and to have a trial before a judge or jury, electing instead that all disputes be resolved by arbitration as set out above.
Severability.
If the Class Action Waiver above is found unenforceable as to any claim, that particular claim shall be severed and adjudicated in a court of competent jurisdiction in Orange County, New York, while all remaining claims proceed in arbitration.
9. Changes to These Terms
We may revise these Terms from time to time. Revised Terms will be posted on this page with an updated "Last updated" date; continued use of the Services constitutes acceptance of the revised Terms.
